Who are we?

The Mailim Service ("Service") is provided by Turktell Bilişim Servisleri A.Ş. (hereinafter referred to as "Turktell", "we" or "our") through its website at mailim.com ("Website") and Mailim Application ("Application").

Turktell is committed to protecting and securing your personal data in accordance with the Law No. 6698 on the Protection of Personal Data (hereinafter referred to as the "Law").

This Clarification Text regulates the methods by which personal data may be obtained, used and shared. For the interpretation of terms not defined in this Clarification Text, the definitions within the scope of Turktell's Mailim End User Agreement ("Terms of Use") shall be taken into consideration.

Your Personal Data that may be processed by Turktell

Although the information contained in this text may differ from person to person due to the products and services that people benefit from or their requests and consents, the categories of your personal data that may be processed by Turktell are specified below.

  • Identity Information: It refers to name, surname, username and date of birth data.
  • Subscription Information: It refers to the user number data.
  • Contact Information: It refers to the line number, e-mail, authentication, recovery e-mail and password data types used to access the account.
  • Usage and Behavioral Information: It refers to various technical data collected from your devices, your preferred language, active periods, types of services used, habits related to the Website and Application interface, last login date, data on errors that occur during the use of the Website and Application.
  • Device Information: It refers to data types such as IP address, device brand and model, device operating system, phone usage language, information on which operator the user uses, country information and internet connection type.
  • Complaint and Request Data: These are the data contained in the content of your requests and complaints that you submit to Turktell as a user.

Method, Purpose and Legal Basis of Processing Personal Data

Your personal data may be processed by Turktell and Group Companies, or by third parties providing services to them, using artificial intelligence or various software by fully automated or partially automated methods through the website, mobile applications, text messages, electronic mail and voice response system in line with the legal reasons and purposes listed below.

• Cases expressly stipulated by law

The personal data listed in this Clarification Text may be processed in accordance with the legislation if it is expressly stipulated in the local or foreign legislation to which Turktell is subject.

  • Processed data: Identity, Subscription and Contact Information, Usage and Behavioral Information, Device Information, Complaint and Request Data.
  • Purposes of processing: Fulfillment of legal obligations required or mandated by regulatory and supervisory bodies and legal regulations, and execution of legal proceedings and legal processes fall within this scope.

• Necessity of processing Personal Data belonging to the parties to the contract, provided that the personal data processing is directly related to the establishment or performance of a contract

Turktell processes your personal data in order to provide the Service to you in accordance with the Terms of Use and our service standards.

  • Processed data: Identity, Subscription and Contact Information, Usage and Behavioral Information, Device Information, Complaint and Request Data.
  • Purposes of processing: Performing and following up the transactions you have requested regarding products and services, developing, diversifying, measuring, auditing and analyzing products and services and networks, conducting activities such as employee training, financial reporting, evaluating your interest in products and services, researching customer satisfaction, responding to questions, complaints and notifications from you, the operation and functioning of the Website and the Application through the Website and the Application or personal data provided or collected in connection with the Website and the Application, such as transactions, preferences and usage habits data, IP address information, device brand and operating system information, device usage language, operator and country information used are included in this scope.

• Compulsory data processing for the fulfillment of Turktell's legal obligations

The data listed in this Clarification Text may be processed in cases where it is mandatory for the fulfillment of obligations within the framework of the legal regulations to which Turktell is subject.

  • Processed data: Identity, Subscription and Contact Information, Usage and Behavioral Information, Device Information, Complaint and Request Data.
  • Purposes of processing: Meeting the requests from authorized institutions and organizations, managing the processes of meeting User requests and complaints, data processing activities arising from the secondary legislation to which Turktell is subject to in order to resolve possible disputes and which are mandatory in order to protect the rights or security of the parties, and the preservation of your information that must be kept in accordance with the relevant legislation, copying, backing up, ensuring the consistency of your information in order to prevent information loss, and taking the necessary technical and administrative measures for the security of our networks and your information are included in this scope.

• Publicization of personal data by the data subject

During the use of the Service, your personal data that you voluntarily share to be seen by Turktell and other users according to your preference are processed.

  • Processed data: Profile photo
  • Purposes of processing: Allowing your profile photo to be seen by other users at your request is included in this scope.

• Compulsory personal data processing being mandatory for the establishment, exercise or protection of a right

Personal data may be processed in cases where it is mandatory for the user and third parties to exercise their rights arising from the law or to be provided by Turktell.

  • Processed data: Identity, Subscription and Contact Information
  • Purposes of processing: Exercising the rights arising from the laws, especially the fundamental rights and freedoms of the user and third parties, before all competent authorities, executing complaint management processes, confirming your identity information and documents when necessary, and taking necessary actions to prevent abuses, loss and fraud are included in this scope.

• Compulsory processing of personal data for Turktell's legitimate interests

Turktell may process personal data if it is mandatory for its legitimate interests, provided that the fundamental rights and freedoms of the user are not harmed. In cases where personal data is processed based on this condition, Turktell clearly determines what its legitimate interests are and ensures the balance between its interests and the rights of users. The protection of the fundamental rights of users, especially the right to privacy, confidentiality and personality rights, is the first priority.

  • Processed data: Identity, Subscription and Contact Information, Usage and Behavioral Information, Device Information.
  • Purposes of processing: Measurement and improvement of service quality, service analysis, audit and control, risk management, detection of unauthorized and fraudulent use, product and strategy development. Provision of services within the scope of the service and responding to your needs within the framework of your transactions and preferences, development of such services and detection, audit and control of unauthorized and fraudulent use are included in this scope.

In case you give your explicit consent

If you activate certain settings of your device (access to camera, video and photos), your personal data is processed based on your explicit consent.

Where is Personal Data Stored?

Turktell servers are located in Turkey and all usage data is stored in Turkey.

To whom and for what purposes is personal data transferred?

Turktell may share the personal data it obtains with the following parties in accordance with this Clarification Text. The information under this heading may differ from person to person depending on the products and services used by the persons, their requests and consents, and the reasons for compliance with the law.

• Authorized institutions and organizations in line with legal obligations:

Turktell may share personal data within a legal obligation with the competent authorities to which it is obliged to provide personal data and to protect its own rights and security, as well as the rights or security of third parties. Turktell examines whether the requesting parties are authorized before sharing personal data.

• Suppliers and business partners we work with:

In case it is necessary for the supply or delivery of the products and services you want to purchase or use, Turktell may share your personal data with the relevant suppliers and business partners, limited to the specified purpose.

• Group companies (“Group Companies”) listed at https://www.turkcell.com.tr/tr/hakkimizda/genel-bakis/istiraklerimiz and authorized persons acting on behalf and account of Turktell:

Your personal data may be shared by Turktell with relevant parties to the extent necessary within the scope of your explicit consent given to Turktell or during the provision of the products and services you benefit from. Your username and password that you will share during the login process to other e-mail addresses that can be used in the Application other than My Mail are processed by third party service providers. We would like to remind you that if you use this feature, you will be subject to the terms and privacy policies of these service providers.

Your Rights Regarding Your Personal Data

Service users may exercise the following rights pursuant to Article 11 of the Law:

  • To learn whether personal data is being processed,
  • To request information if their personal data has been processed,
  • To learn the purpose of processing personal data and whether they are used for their intended purpose,
  • To learn the third parties to whom personal data is transferred domestically or abroad,
  • To request correction of personal data in case of incomplete or incorrect processing,
  • To request the deletion or destruction of personal data within the framework of the provisions specified in Article 7 of the Law,
  • To request notification of the correction, deletion or destruction of personal data to third parties to whom personal data are transferred,
  • To object to the processing of personal data exclusively through automated systems,
  • In case of damage due to unlawful processing of personal data, to demand compensation for the damage.

In order for us to assist you in determining which data you wish to exercise your rights under the Law, please provide as much detailed information as possible about the data for which you wish to exercise your rights. The information provided will be free of charge unless the request is manifestly unfounded or disproportionate (in which case a reasonable fee may be charged or your request may be rejected).

You can send your questions and requests regarding your Personal Data by one of the following methods:

  • By sending an e-mail to bulutdestech@superonline.net address prepared in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller by using your e-mail address notified to Turktell when registering to the Service and registered in our systems,
  • By sending your request to "Turkcell Headquarters Aydınevler Mahallesi İnönü Caddesi No:20 Küçükyalı Ofis Park B Blok - Maltepe/İstanbul" address via notary public in accordance with the Communiqué on Application Procedures and Principles to the Data Controller.

Turktell reserves the right to request additional information and/or documents to confirm your identity in order to ensure data security in the applications submitted.

About the Clarification Text

Turktell may amend this Clarification Text at any time if necessary. In such a case, the updated Clarification Text will be published on the Website and presented to your attention. Updates and changes made by Turktell in the Clarification Text shall be valid as of the date of publication on the Website.
